Terms of Service

These Terms of Service ("Terms") govern your use of Markup.fyi ("the Service"), operated by Markup.fyi ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service Description

Markup.fyi is an AI-powered writing analysis tool. The Service provides:

  • Multi-lens text analysis (including AI pattern detection, clarity editing, and logical reasoning checks) powered by the Google Gemini API.
  • Actionable flags identifying potential issues in your writing, with severity ratings and explanations.
  • Remix suggestions offering alternative phrasings for flagged passages.
  • Free and Pro subscription tiers with different feature access and usage limits.

The Service is advisory and probabilistic in nature. Analysis results are suggestions, not definitive assessments.

2. Accounts & Registration

  • Guest access — you may use limited features of the Service without creating an account.
  • Pro accounts — accessing Pro features requires account registration and an active subscription.
  • You are responsible for maintaining the security of your login credentials and for all activity that occurs under your account.
  • One account per person. Creating multiple accounts to circumvent rate limits or other restrictions is prohibited.
  • You must provide accurate and complete information during registration and keep it up to date.

3. Your Content

  • Ownership — you retain full ownership of all text and content you submit to the Service. We do not claim any intellectual property rights over your content.
  • Limited processing license — by submitting content for analysis, you grant us a limited, non-exclusive license to transmit your text to the Google Gemini API solely for the purpose of performing the requested analysis.
  • License termination — this processing license terminates immediately upon completion of the analysis or deletion of your content, whichever comes first.
  • Analysis output — all analysis results, suggestions, and remixed text generated from your content belong to you.

4. Acceptable Use

You agree not to use the Service to:

  • Submit content that is illegal, threatening, defamatory, or infringes on the intellectual property rights of others.
  • Generate, distribute, or facilitate spam, phishing, or social engineering attacks.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Use automated bots, scrapers, or other programmatic means to access the Service without prior written permission.
  • Resell, sublicense, or redistribute the Service or its output for commercial purposes without authorization.
  • Interfere with or disrupt the Service, its servers, or connected networks.
  • Create multiple accounts to circumvent rate limits or other restrictions.

5. Payment Terms

  • Pricing — Pro subscriptions are available at $18/month (monthly billing) or $12/month ($144/year, billed annually).
  • Billing — all payments are processed securely through Stripe. We do not store your payment card details.
  • Cancellation — you may cancel your subscription at any time. Upon cancellation, you retain access to Pro features until the end of your current billing period, after which your account reverts to the free tier.
  • Refunds — we offer a prorated refund within 14 days of your initial subscription or most recent renewal. After 14 days, refunds are not available, but you retain access through the end of your billing period.
  • Price changes — we will provide at least 30 days' notice before any pricing changes take effect. Existing subscribers will be notified via email.

6. Service Availability

We provide the Service on a best-effort basis. We do not guarantee uninterrupted or error-free operation.

  • The Service depends on third-party providers (Google Gemini API, Stripe, Convex, Vercel) whose availability is outside our direct control.
  • We may perform scheduled maintenance with reasonable advance notice.
  • If we discontinue the entire Service, we will provide at least 30 days' notice and assist Pro users with data export.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Decisions you make based on the Service's analysis output.
  • Loss of data, revenue, or business opportunities arising from use of the Service.

Our total liability for any claims arising from or related to the Service is limited to the lesser of: (a) the total amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

8. Advisory Disclaimer

  • Markup.fyi is a writing assistance tool, not an authority on writing quality, style, or correctness.
  • AI detection analysis is probabilistic, not proof. A flag does not mean text was AI-generated; it means the text exhibits patterns commonly associated with AI output.
  • Suggestions and remix options represent one possible perspective. They may not be appropriate for your specific context, audience, or intent.
  • The Service is not suitable for legal compliance, academic integrity determinations, or any purpose where a definitive assessment of AI authorship is required.
  • We make no guarantee that following our suggestions will achieve any particular outcome regarding content quality, audience reception, or AI detection scores on other platforms.

9. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

  • Binding arbitration — any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
  • Class action waiver — you agree to resolve disputes on an individual basis only. You waive the right to participate in class actions, class arbitrations, or representative proceedings.
  • Exceptions — either party may seek injunctive or equitable relief in court for matters involving intellectual property rights or unauthorized access to the Service.

10. Age Restriction

You must be at least 18 years old to use the Service. This requirement is mandated by the Google Gemini API Terms of Service, which powers our analysis features. By using the Service, you represent and warrant that you meet this age requirement.

11. Modifications

  • Material changes — we will provide at least 30 days' notice via email and a prominent in-app banner before material changes to these Terms take effect.
  • Minor changes — we will update the "Last updated" date at the top of this page.

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
